These Terms and Conditions ("Terms") govern your use of our website and coaching services. By engaging our services or using our website, you agree to be bound by these Terms.

Please read these Terms carefully and in conjunction with our Privacy Policy,

Legal Disclaimer, and Accessibility Statement.

1. DEFINITIONS

"We", "us", "our" means Forge Forward Coaching Limited
"You", "your", "Client" means the person or entity engaging our services
"Services" means professional career and personal coaching, leadership mentoring, and job application to interview preparation support services
"Session" means an agreed coaching consultation, whether delivered in-person, via video (Teams or Zoom), or by phone

2. SERVICES PROVIDED

2.1 We provide bespoke professional coaching services including:

  • Career coaching and guidance

  • Personal development coaching

  • Leadership mentoring

  • CV and resume writing

  • Job application support

  • Interview preparation and practice

  • Application to Interview programs

  • Youth mentoring – pathways for trades

2.2 All services are tailored to your individual needs and circumstances.

2.3 Our services are delivered via:

  • Video conferencing (Microsoft Teams or Zoom)

  • In-person sessions at your location or mutually agreed venue

  • Phone consultations

  • Email support

2.4 We reserve the right to modify, add, or discontinue any service offerings at our discretion.

3. NOT A SUBSTITUTE FOR SERVICES NOTED:

  • Mental health counselling or therapy

  • Medical advice or treatment

  • Legal advice

  • Financial advice

  • Human resources or employment law guidance

3.2 If you require professional services in these areas, please consult appropriately qualified professionals.

4. FEES AND PAYMENT TERMS

4.1 Service Rates

  • Rates are noted on the website for services provided

  • Professional coaching rate is $275 NZD per hour (plus GST where applicable)

  • Package rates and programs are quoted separately based on scope

  • All fees will be confirmed in writing before services commence

4.2 Payment Schedule

Payment for coaching services is typically structured as follows:

  • Per Session: Payment due after each scheduled session within 5 working days

  • Program Packages: 50% deposit required to secure booking, with remaining 50% due at the midpoint of the program

  • Ongoing Engagements: Payment due monthly in advance

4.3 Payment Methods

We accept payment via:

  • Bank transfer

4.4 Late Payment

  • Payment is due as per the agreed schedule

  • A late fee of $25 will apply to invoices unpaid after 14 days

  • We reserve the right to suspend services until outstanding payments are received

4.5 Price Changes

  • We reserve the right to adjust our fees with 30 days' notice

  • Any price changes will not affect services already booked and paid for

 

5. BOOKING AND SCHEDULING

5.1 Sessions are scheduled by mutual agreement via email, or we contact you by phone.

5.2 You are responsible for joining video calls or making phone calls at the agreed time.

5.3 We will ensure availability at all scheduled times unless exceptional circumstances arise.

 

6. CANCELLATION AND RESCHEDULING

6.1 Client Cancellations

  • You must provide at least 48 hours' notice to cancel or reschedule a session

  • Cancellations with less than 48 hours' notice will incur a fee of 50% of the session cost

  • No-shows (failure to attend without notice) will be charged at 100% of the session cost

6.2 Rescheduling

  • Sessions may be rescheduled once without penalty with 48+ hours' notice

  • We will make reasonable efforts to accommodate your rescheduling requests

6.3 Coach Cancellations

  • If we need to cancel or reschedule, we will provide as much notice as possible

  • You will not be charged for any session we cancel

  • We will work with you to reschedule at a mutually convenient time

 

7. WITHDRAWAL FROM SERVICES

7.1 Client Withdrawal

If you wish to withdraw from coaching services during a program:

  • You must notify us in writing via email

  • Work completed to date will be invoiced at the standard hourly rate

  • A 15% administration and preparation fee will apply to the total value of remaining unpaid services to cover bespoke preparation, materials created, and program design

  • Any refund due will be processed within 14 days

7.2 Example

If you paid a 50% deposit on a 10-hour program ($2,750) and completed 3 hours before withdrawing:

  • Hours completed: 3 × $275 = $825

  • Administration fee: 15% of remaining 7 hours = 15% × $1,925 = $288.75

  • Amount owed: $825 + $288.75 = $1,113.75

  • Refund due: $1,375 - $1,113.75 = $261.25

7.3 Coach Termination

We reserve the right to terminate services in exceptional circumstances including:

  • Inappropriate or abusive behaviour

  • Non-payment of fees

  • Conflict of interest

  • Circumstances beyond our control

In such cases, you will receive reasonable notice where practical and a refund for any prepaid unused services.

 

8. PROGRESS AND VARIATIONS

8.1 If work is not progressing as expected or challenges arise, you must notify us immediately.

8.2 At the conclusion of any engagement, we will provide a summary of work completed. Please note in writing additional costs.

8.3 Any scope variations or additional work beyond the original agreement requires our prior written approval.

8.4 We reserve the option to invoice for additional costs incurred due to scope changes or client-requested variations.

9. CLIENT RESPONSIBILITIES

You agree to:

  • Provide accurate and complete information

  • Attend scheduled sessions on time

  • Complete any agreed pre-post work or preparation

  • Implement strategies and recommendations as appropriate

  • Verify any information or advice with relevant professionals where necessary

  • Conduct your own research on potential employers or opportunities

  • Ensure accuracy of information in your CV, applications, and other materials

  • Make your own career and personal decisions

 

10. NO GUARANTEE OF RESULTS

10.1 While we are committed to providing high-quality coaching support, we cannot and do not guarantee specific outcomes including:

  • Job offers or employment

  • Interview invitations

  • Salary increases or promotions

  • Career advancement

  • Achievement of specific goals

  • Specific timelines for success

10.2 Your success depends on many factors including your effort, commitment, market conditions, and circumstances beyond our control.

 

11. CONFIDENTIALITY

11.1 We will maintain confidentiality of all information shared during coaching sessions in accordance with our Privacy Policy.

11.2 We may use anonymized case studies or testimonials for marketing purposes with your explicit consent.

11.3 Confidentiality may be broken only where:

  • Required by law

  • Necessary to prevent harm to you or others

  • You provide explicit permission

 

12. INTELLECTUAL PROPERTY

12.1 All materials, frameworks, documents, and content created by us remain our intellectual property unless otherwise agreed in writing.

12.2 You may use materials provided for your personal career development but may not reproduce, distribute, or sell them.

12.3 Your personal information, CV content, and application materials remain your property.

13. LIMITATION OF LIABILITY

13.1 To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from our services.

13.2 Our total liability to you shall not exceed the total fees paid by you for the specific services in question.

13.3 Nothing in these Terms excludes liability that cannot be excluded under New Zealand law.

14. THIRD-PARTY SERVICES AND LINKS

14.1 Our website and services may include links to third-party websites, tools, or resources.

14.2 We do not endorse or take responsibility for third-party content, accuracy, or practices.

14.3 Your use of third-party services is at your own risk.

15. WEBSITE USE

15.1 You may use our website for lawful purposes only.

15.2 You must not:

  • Use the website in any way that violates applicable laws

  • Attempt to gain unauthorized access to our systems

  • Introduce viruses, trojans, or other malicious code

  • Collect data from the website using automated means

  • Use the website to transmit spam or unsolicited communications

 

16. DATA PROTECTION

16.1 We collect and process your personal information in accordance with our Privacy Policy and the Privacy Act 2020 (New Zealand).

16.2 By using our services, you consent to such collection and processing.

 

17. COMMUNICATIONS

17.1 By engaging our services, you consent to receive:

  • Service-related communications (confirmations, reminders, updates)

  • Administrative notices

  • Marketing communications (if you opt in)

17.2 You may opt out of marketing communications at any time.

 

18. FORCE MAJEURE

18.1 We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control including:

  • Natural disasters

  • Pandemics or health emergencies

  • Government restrictions

  • Technology failures

  • Other acts of God

 

19. DISPUTE RESOLUTION

19.1 If a dispute arises, we encourage you to contact us first to seek resolution.

19.2 We will work in good faith to resolve any concerns.

19.3 If resolution cannot be achieved, disputes shall be resolved in accordance with New Zealand law.

 

20. AMENDMENTS TO TERMS

20.1 We reserve the right to modify these Terms at any time.

20.2 Changes will be effective immediately upon posting on our website with an updated "Effective Date."

20.3 Material changes will be communicated via email where possible.

20.4 Your continued use of our services after changes constitutes acceptance of the modified Terms.

21. SEVERABILITY

21.1 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

22. ENTIRE AGREEMENT

22.1 These Terms, together with our Privacy Policy, Legal Disclaimer, and Accessibility Statement, constitute the entire agreement between you and Forge Forward Coaching Limited.

22.2 Any amendments must be made in writing and agreed by both parties.

23. GOVERNING LAW

23.1 These Terms are governed by the laws of New Zealand.

23.2 Any disputes shall be subject to the exclusive jurisdiction of the New Zealand courts.

24. ACCEPTANCE OF TERMS

By engaging our services, booking a session, or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
